Lowe and Ellen Schoolar, contend in a suit filed in Chatham County Superior Court.

Jones and her children were forced to move in with family members following the problems, the suit alleged.

According to the suit, the design and construction of Jones' apartment were defective because no provisions were put in place to prevent rainwater from seeping under the wall and into the unit; no provisions were put in place to prevent rainwater from seeping into the apartment from the breezeway and into the apartment, and that without permanent corrective measures water continued to infiltrate the apartment.

After Jones obtained results of a mold inspection and realized her apartment was not going to be made inhabitable, she removed her belongings from the apartment over Labor Day weekend.

She then hand-delivered her keys and a copy of her notice of constructive eviction to agents for the landlord on Sept. 4 along with a demand for return of her $500 security deposit, the suit alleged.

The landlord and property manager "have failed to return any portion of Ms. Jones' security deposit to her," the suit alleged.

Jones, who is suing for herself and her children, ages 10 months to 10 years, is seeking damages including $1,500, or three times the $500 security deposit, which they allege was "wrongfully withheld," and $3,004 in hospital and medical expenses for her and her children's medical treatment.

She also wants punitive damages against Mercy Housing SE and Mercy Housing Inc. to punish and deter them from repeating their alleged wrongful acts.

"Mercy Housing X has acted in bad faith, has been stubbornly litigious and has caused Ms. Jones unnecessary trouble and expense," the suit contends. Jones'

The suit also alleges that neither Mercy Housing X, Mercy Housing Southeast nor Mercy Housing Inc. offered to move Jones and her children to a hotel or make any other suitable accommodations while their unit was uninhabitable. Their offer to move her to Unit 113 at the property was rejected because Jones knew it was mold-infested and had recently been vacated by another tenant because of extensive mold problems, the suit contends. Jones' apartment was one of at least 12 units at the 515 Pennsylvania Ave. property in which various problems were found, including water intrusion, mold and mildew, leaking air conditioners and plumbing and a defective ice maker.

The apartment was one of 115 units in Phase I of the planned development, including 310 affordable housing apartments and up to 120 single-family homes on the 44-acre site.

The development replaced and was intended to revitalize the former Strathmore Estates, a collapsing, crime-ridden World War II-era privately owned, low-income housing complex on Pennsylvania Avenue.

It was called an effort to undo blight and provide affordable housing for residents.
